Our commercial litigation team is experienced in handling all manner of contractual disputes, including warranty claims flowing from corporate acquisitions or disposals, shareholders' disputes and distribution and agency matters.

Tortious issues frequently litigated include breach of fiduciary duty, use of confidential information, defamation, fraud, professional negligence and tracing. Our team is also highly experienced in dealing with intellectual property disputes.

Our lawyers regularly appear before Ireland’s High Court, Court of Appeal and Supreme Court. They routinely appear before Ireland's Commercial Court and are familiar with the streamlined procedures and deadlines imposed by that court.  Utilisation of Ireland’s Commercial Court by litigants has proven to be a quick and effective forum for conducting high value commercial litigation. The time from the commencement of the proceedings to delivery of judgment following a trial is often less than six months.

Our commercial litigators have handled major competition law cases, cases before the European Court of Justice and a wide range of banking related litigation. They also have expertise in insolvency related litigation, acting frequently for insolvency office holders, banks or creditors involved in insolvency proceedings.

  • Advised a not-for-profit entity in the defence of a US$45million claim against it, arising out of the termination of a licence agreement. 
  • Advising a corporate entity in a commercial court claim in which it is seeking to recover US$29billion arising from the collapse of the Madoff ponzi scheme.
  • Acting for UPC, a major internet service provider, in copyright infringement proceedings taken by the Irish recording companies to combat illegal P2P filesharing seeking the introduction of a court ordered graduated response system.
