Advising on nursing home transfer to the HSE Sisters of St Marie Madeleine Postel: divestment of Mount Carmel Nursing Home

News Charity and Not-for-Profit 09 Jul 2026

We recently advised our client, the Sisters of St Marie Madeleine Postel, on their successful divestment of Mount Carmel Nursing Home in Roscrea, Co. Tipperary, to the Health Service Executive (HSE).

The transaction marks the end of an illustrious era of care in Mount Carmel Nursing Home under the direct stewardship of the Sisters, while successfully securing a sustainable, long-term future for the vital community facility for Roscrea. The comprehensive agreement includes the transfer of the 31-bed facility, 12 independent living units, the historic Convent building and the surrounding site.

This transaction highlights a growing trend across the voluntary and healthcare sectors, where our Charities & Not-for-Profit team is increasingly advising religious charities on the strategic divestment of their services and associated properties to State bodies, operators and agents to ensure continuity of care.

Commenting on the transaction, Alice Murphy, Charity and Not-for-Profit Partner, said:

"We are delighted to have supported the Sisters of St Marie Madeleine Postel on this significant transaction. Navigating the divestment of important care facilities requires a delicate balance of regulatory compliance, employment continuity and real estate structuring, while always bearing in mind the particular ethos of the institution. The success of this deal is a direct testament to the extraordinary stewardship and vision of the Sisters’ leadership. Their unwavering commitment ensured not only the long-term protection of 62 local jobs but also guaranteed that the people of Roscrea and its surrounding areas will benefit from this excellent healthcare facility for generations to come."

The transaction team was led by Alice Murphy, assisted by Eimear Lyons, Lydia Bentley, Marcus Kennedy and Airy Cleere with key support from our Employment Law & Benefits and Data & Technology teams.
