Negotiators commonly refer to “what’s market practice” and “what’s off-market” as a bargaining tool in negotiating contracts. During this webinar, we outlined our experience of “what’s market” on key contract clauses in areas such as liability caps, indemnities, force majeure, good faith, Brexit and more.
