Frank Flanagan Interviewed by The Sunday Times

Frank Flanagan, Partner in our Dispute Resolution team, was interviewed by The Sunday Times on the topic of examinership.
The piece was set against the backdrop of Arena Capital Partners’ interim examinership.
Frank’s expertise provided valuable context on the role of the examiner and the conditions required for a successful scheme of arrangement.
He outlined that the overall test in any examinership is if the examiner can come up with a scheme, which provides for the survival the company and of all or part of its business and which doesn’t unfairly prejudice any interested party.
Frank commented:
“If an examiner can get a scheme together and get over the hurdle of any potential wrongdoing, the chances are that everybody, including the note holders, will do better than they would in a liquidation.”
