Our Public Procurement team outlines the new EU thresholds that will apply to public procurement procedures from 1 January 2024.

From 1 January 2024, new thresholds will apply for the application of the EU Public Procurement Directives. These updated thresholds are as follows:

Public Procurement Directive

Utilities Directive

Concessions Directive

These thresholds were last updated on 1 January 2022. The thresholds are net of VAT and apply over the duration of a contract or framework agreement (including all potential extensions and options).

It is important to bear in mind that, even if the value of a procurement falls below the applicable EU threshold, it is still subject to the national thresholds and rules as most recently set out in Circular 05/2023 published by the Department of Public Expenditure, NDP Delivery and Reform. These national thresholds and rules are summarised in a previous update.

In addition, all contracts with the potential for cross-border interest must be awarded in accordance with the general EU principles, including the principles of transparency, equal treatment, non-discrimination, proportionality and mutual recognition.
