We hosted our second annual Commercial Contracts: What’s Market? webinar on Thursday 10 June. Following on from the success of our 2020 research and webinar on contract negotiation, market practice and what would be considered off-market, we launched our 2021 survey of Irish and international in-house counsel.

During the webinar, our speakers outlined our experience of “what’s market” on key contract clauses in areas such as liability caps, indemnities, force majeure, good faith, Brexit and more. We presented data from our own database of negotiated client agreements, and shared the results of the in-house counsel survey on these issues. We discussed the current legal position on these common contracting issues and gave key take-aways to assist with negotiating commercial contracts.
