Commercial Litigation
Mason Hayes+Curran has a thriving commercial litigation practice. Its lawyers regularly appear before Ireland’s Commercial Court and are familiar with the streamlined procedures and demanding deadlines imposed by that court. Utilisation of Ireland’s Commercial Court by litigants has proven to be an exceptionally speedy way of disposing of high value commercial litigation. The time from the commencement of the proceedings to delivery of judgment following a trial is often less than six months.
The nature of matters litigated is diverse.
All manner of contractual disputes are handled, including distribution and agency matters, warranty claims flowing from corporate acquisitions or disposals, shareholders' disputes and construction matters.
The seeking of injunctive relief allied to a substantive action is commonplace. Tortious issues frequently litigated include breach of fiduciary duty, use of confidential information, fraud, professional negligence and tracing.
