Will, Probate & Trust Disputes

Unfortunately it is not uncommon for disputes to arise in relation to the administration of estates or trusts for a variety of reasons. The Private Client team has very considerable experience in dealing with such conflict, including disputes between beneficiaries, disputes over the statutory entitlements of third parties and claims against estates and trusts.

We can act in a wide variety of contentious matters, including:

  • section 117 claims by a child or children against the estate of a deceased parent
  • claims by a spouse against an estate seeking a 'legal right share' or otherwise
  • acting in the administration of insolvent estates
  • cases involving the disputed interpretation of a Will
  • bringing or defending actions against executors and/or trustees in relation to the administration of estates
  • bringing or defending claims against estates generally
  • acting for trustees or beneficiaries in relation to any dispute regarding the operation of a trust
