Mason Hayes & Curran has a thriving commercial litigation practice. We handle all manner of contractual disputes, including warranty claims flowing from corporate acquisitions or disposals, shareholders' disputes and distribution and agency matters.

Tortious issues frequently litigated include breach of fiduciary duty, use of confidential information, fraud, professional negligence and tracing.

Our lawyers regularly appear before Ireland’s Commercial Court and are familiar with the streamlined procedures and deadlines imposed by that court.  Utilisation of Ireland’s Commercial Court by litigants has proven to be a quick and effective forum for conducting high value commercial litigation.  The time from the commencement of the proceedings to delivery of judgment following a trial is often less than six months.

The firm's commercial litigators have also handled major competition law cases, cases before the European Court of Justice and a wide range of banking related litigation.

The firm also has expertise in insolvency related litigation, acting frequently for insolvency office holders, banks or creditors involved in insolvency proceedings.

Our commercial litigators also handle property related litigation, including such matters as disputes over option agreements, a wide range of landlord and tenant issues and other matters as diverse as trespass and property related fraud.

Practitioners have wide experience in the operation of the Brussels and Lugano Conventions and have made successful applications for provisional or protective relief pursuant to the Conventions. The firm frequently acts in multijurisdictional litigation.
