Employment Law+Benefits

The Employment Law and Benefits Group advise on all aspects of workplace legal issues, both contentious and non-contentious in nature, and does so for a variety of clients in the public and private sectors. There are 15 lawyers in the Employment Law and Benefits Group and the group continues to experience significant growth.

The team represent local and international corporates with business in Ireland, in the areas of employment law, pensions, employee share schemes, corporate immigration, health and safety and general workplace issues. It also regularly advises senior employees in respect of their positions.

As well as handling a large volume of employment disputes, the Employment Law and Benefits Group provide a complete dispute avoidance service to its clients. The Group audits the policies and procedures of corporate clients and provides on-site training in employment and health & safety issues.   In corporate deals, the Group advises on Transfer of Undertakings and relatedissues.

The Employment Law and Benefits Group also advise employers and trustees in relation to all aspects of pension law, including employers’ PRSA obligations.  The Group regularly advise employers and trustees in relation to their duties and responsibilities under pension scheme documentation, pensions legislation and trust law generally.

The Education/Healthcare Unit specialises in advising education and healthcare providers on all workplace legal issues, both contentious and non-contentious. Its education clients comprise all the main education management associations and a large number of individual educational institutions, at primary, secondary and third level.  It also advises extensively in the healthcare sector, advising HR departments in a number of large voluntary hospitals. 

This unit came to MH+C when the firm merged with the very long established firm of Arthur O’Hagan, Solicitors which firm has been providing legal services traditionally to religious institutions in the education and health fields for some 150 years, a practise which has widened in recent years to cover non-religious educational bodies.

The Employment Law and Benefits Group regularly publish information memoranda and organise seminars at which clients are kept up to date on the ever increasing volume of employment legislation.

This thriving employment and employee benefits department advises clients from both the private and public sectors on the full scope of employment matters, including litigation, employment appeal tribunals and High Court proceedings. On the advisory side, the workload includes TUPE, immigration, redundancies and dismissals, e-mail and Internet usage policies and the drafting and reviewing of employee handbooks and contracts. It handles an increasing amount of work relating to non-compete clauses in employment contracts and also provides support to the corporate team, advising on the employment aspects of M&A transactions.
