About Naomi

Naomi is a Senior Associate in our Debt Recovery Department.

Naomi currently manages debt collection litigation, with a focus on enforcement of security for debts. She acts for a number of high street lenders and other financial institutions. Generally, the debtors are individuals in default of loan agreements with substantial arrears having accrued on their mortgage accounts.

Naomi and her team review the security and ensure the Bank is compliant with its regulatory obligations e.g. C.C.M.A., Consumer Credit Act etc. Naomi engages with the debtors, where appropriate, negotiating sustainable arrangements on foot of up-to-date Standard Financial Statements or alternatively negotiating the voluntary surrender of the security property. She initiates and progresses residential repossession litigation within the Circuit Court and High Court and where possible, successfully obtains orders for possession.

Naomi also deals with summary proceedings against debtors for monetary judgment where, for example a shortfall arises after the sale of secured property. She also pursues judgment proceedings against guarantors for obligations arising out of indemnities/guarantees they may have provided on behalf principal debtors, such as limited companies. She also advises creditors in respect of their rights, where a debtor has transferred assets, in a bid to frustrate a creditor seeking to enforce a judgment against such assets and has experience in running fraudulent transfer cases.
