Breakfast Seminar on Pre-nuptial Agreements, November 24

Mason Hayes & Curran in association with Withers LLP hosted a breakfast seminar on Pre-nuptial Agreements, on Wednesday 24 November.

The seminar surrounded the recent landmark decision on Radmacher -v- Granatino by the Supreme Court (England & Wales) which has opened the door to the recognition of pre-nuptial agreements.

The decision is likely to prove persuasive before the Courts in Ireland. Therefore, this event proved essential for both Irish and UK advisors and intermediaries to consider the advantages and disadvantages for their clients of entering pre-nuptial agreements.
 
On the day, leading experts interpreted the practical issues arising as a result of this decision and how this might impact in Ireland, speakers and topics were as follows:

Speakers and Topics:

Ms. Inge Clissmann SC, former Chairperson of the Government Working Group on Pre-nuptial Agreements addressed the topic from an Irish perspective, taking into account the provisions of the Irish Constitution, the Family Law (Divorce) Act1996 and proposed new legislation.

Mr. Michael Gouriet and Ms. Suzanne Todd, Family Law Partners of Withers LLP outlined the reasoning applied by the Supreme Court identifying some key factors which are likely to determine the weight the Courts should give such Agreements.

Jennifer O’Brien, Family Law Partner at Mason Hayes & Curran identified the practical issues arising for family law solicitors and their clients, in entering a new era of self-determination within a ‘fair’ framework where no attempt is made to oust the jurisdiction of the Court.

Donagh McGowan, Partner and Head of Private Client, Mason Hayes & Curran acted as Chairman for the event.
